These General Terms and Conditions of Sale, hereinafter referred to as the “GTC”, govern the sale of products by Bastien Campistron to consumers through the bastiencampistron.com website.
Placing an order implies that the Customer has read these GTC and accepts them under the conditions set out below.

These GTC define the rights and obligations of the Seller and its Customers in connection with the distance sale of products presented on the website.
They apply primarily to the sale of physical products, including:
– photographic calendars.
– photographic prints.
– Forex prints.
– paper prints.
– compressed cardboard prints.
– Dibond prints.
– banner prints.
– wallpaper prints.
– limited editions and limited prints.
– as well as any other printing medium offered on the website.
The essential characteristics of each product, including its format, medium, price and, where applicable, specific manufacturing features, are presented on the relevant pages of the website.
These GTC prevail over any contradictory document, except for special terms expressly accepted by both parties.
The Seller takes great care in presenting and describing the products offered.
The photographs and visuals displayed on the website are intended to represent the products as faithfully as possible.
However, colour rendering may vary slightly depending on the screen used, the Customer’s device settings, the printing process or the nature of the selected medium.
Such reasonable differences in colour or rendering do not necessarily constitute a lack of conformity where the product corresponds to the characteristics announced at the time of the order.
Photographic prints may be offered in different formats and on different media according to the options presented on the website.
Product prices are stated in euros.
The applicable price is the price communicated to the Customer at the time of the order or its confirmation.
Unless otherwise stated, preparation, packaging and delivery costs are not included in the displayed product price.
Where delivery charges apply, their amount is communicated to the Customer before final confirmation of the order.
The total price payable by the Customer is therefore communicated before the Customer becomes definitively bound.
The Seller reserves the right to change its prices at any time. However, a price change does not affect an order that has already been definitively accepted.
The Customer may submit an order request using the forms available on the website.
The Customer must provide accurate and sufficiently complete information to allow the request to be processed, including:
– name.
– email address.
– delivery address.
– city and country.
– requested product.
– requested quantity.
– and, where necessary, the characteristics of the requested print or medium.
Submission of a form on the website constitutes an order request.
Where all necessary information has not yet been determined when the form is submitted, including delivery charges, the sales contract is only definitively concluded after the total price has been communicated to the Customer and the order has been accepted under the conditions indicated by the Seller.
The Seller reserves the right to request additional information where necessary for the manufacture, payment or delivery of the product.
The Seller may refuse or cancel an order request for legitimate reasons, including product unavailability, impossibility of manufacture, manifestly incorrect information or a previous dispute concerning payment for an order.
The applicable payment methods are communicated to the Customer before the sale is definitively concluded.
The order may be considered definitively confirmed after acceptance of the total price and, where required by the Seller, after actual receipt of payment.
No product requiring specific manufacture will be put into production before the order has been definitively confirmed and, where applicable, the corresponding payment has been received.
The Customer warrants that they have the necessary authorisations to use the selected payment method.
Products are offered subject to available stock or manufacturing capacity.
Certain photographic prints and media may be produced specifically after the order is placed.
In the event of permanent unavailability or inability to produce the ordered product, the Customer will be informed as soon as possible.
Where the Customer has already paid an amount for a product that has become unavailable or impossible to manufacture, that amount will be refunded in accordance with the applicable regulations.
Products are delivered to the address provided by the Customer when placing the order.
The Customer is responsible for checking the accuracy and completeness of the information provided.
The Seller cannot be held liable for the consequences of an address error attributable to the Customer, subject to any mandatory legal provisions that apply.
Delivery costs and arrangements are communicated to the Customer before the order is definitively concluded.
The applicable delivery or dispatch time is communicated to the Customer when the order is confirmed.
Where no specific time limit has been expressly agreed, the product will be delivered without undue delay and no later than within the period required by the applicable regulations.
Delivery times may vary depending in particular on:
– the product ordered.
– the selected medium.
– the time required for manufacture.
– the quantity ordered.
– the destination country.
– and the carrier used.
Where delivery is carried out by a carrier offered by the Seller, the risk of loss or damage to the product passes to the Customer when the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the goods.
The Customer is invited to check the condition of the parcel and the products upon receipt.
If a parcel is visibly damaged, the Customer is invited, where possible, to make any useful reservations with the carrier and to contact the Seller promptly.
The Customer may provide photographs of the parcel and damaged product to facilitate the processing of the claim.
Failure to make reservations with the carrier does not deprive the consumer of the statutory guarantees to which they are entitled.

Subject to the exceptions provided for by law, the consumer has a period of fourteen days in which to exercise the right of withdrawal without having to give any reason.
For the sale of goods, this period begins on the date the product is received by the Customer or by a third party designated by the Customer other than the carrier.
Where several goods forming part of the same order are delivered separately, the period begins on receipt of the last item.
To exercise the right of withdrawal, the Customer must inform the Seller of the decision before the applicable period expires.
The Customer may use the standard form provided at the end of these GTC or submit any unambiguous statement expressing the wish to withdraw.

After communicating the decision to withdraw, the Customer must return the product to the Seller no later than fourteen days after that communication.
Unless the Seller indicates that these costs will be borne by the Seller, the direct cost of returning the product is borne by the Customer.
Products must be properly protected and packaged to prevent damage during return transport.
The Customer may be liable for any diminished value of the product resulting from handling other than that necessary to establish its nature, characteristics and proper functioning.

Where the right of withdrawal is validly exercised, the Seller will refund the amounts due in accordance with the applicable legal provisions.
Where legally required, the refund includes delivery charges corresponding to the standard delivery method offered by the Seller.
Any additional costs resulting from the Customer’s voluntary choice of a delivery method more expensive than the standard method offered are not necessarily refundable.
The Seller may withhold the refund until the goods have been recovered or until the Customer provides proof that they have been dispatched, whichever occurs first.
Unless otherwise agreed with the Customer, the refund will be made using the same payment method as that used for the original transaction.
In accordance with the French Consumer Code, the right of withdrawal may in particular be excluded for goods made to the consumer’s specifications or clearly personalised.
This exception applies only where a product actually meets the legal criteria for being considered personalised.
The mere fact that a photographic print is produced after the order has been received does not therefore automatically exclude the right of withdrawal.
Where a product lawfully falls within this exception, the Customer is expressly informed before the order is concluded.
The consumer benefits from the statutory guarantee of conformity provided for by the French Consumer Code.

The consumer has a period of two years from delivery of the goods in which to obtain implementation of the statutory guarantee of conformity if a lack of conformity appears.
Under the conditions provided by law, the statutory guarantee of conformity gives the consumer the right, in particular, to repair or replacement of the goods free of charge and without major inconvenience.
Where repair or replacement is impossible, or where the conditions provided for by the applicable regulations are met, the consumer may in particular obtain a price reduction or termination of the contract.
Rights arising from this guarantee apply independently of any commercial guarantee that may be offered.
The Customer also benefits from the statutory guarantee against hidden defects provided for by Articles 1641 et seq. of the French Civil Code.
This guarantee may in particular apply where a hidden defect makes the product unfit for its intended use or reduces that use to such an extent that the Customer would not have purchased it, or would have paid a lower price, had they known of the defect.
Any action resulting from hidden defects must be brought within the time limit provided by the applicable legislation from the date on which the defect is discovered.
The photographs displayed on the website and those reproduced on the products sold remain protected by the applicable intellectual property and copyright laws.
The purchase of a calendar, photographic print or any other medium featuring a photograph by Bastien Campistron constitutes only the acquisition of the corresponding physical medium.
Such purchase does not transfer any copyright in the photograph.
Without the prior written authorisation of Bastien Campistron, it is in particular prohibited to:
– reproduce the photograph.
– digitise it for the purpose of reproducing or distributing it.
– market or sell it.
– use it for advertising or commercial purposes.
– modify it.
– publish or distribute it to third parties outside the exceptions provided for by law.
The Seller is responsible for the proper performance of its contractual obligations under the conditions provided by the applicable legislation.
However, the Seller cannot be held liable where non-performance or improper performance of the contract is attributable to the Customer, to an unforeseeable and unavoidable act of a third party to the contract, or to an event of force majeure recognised under French law.
Nothing in these GTC may exclude or limit any mandatory right granted to the consumer by law.
Personal information provided by the Customer is used in particular to:
– process order requests.
– manage orders.
– arrange delivery.
– manage the commercial relationship.
– respond to requests and complaints.
– and comply with the Seller’s legal obligations.

The Customer is invited to include in the request the information required to identify the relevant order.
In the event of a dispute, the consumer Customer must first submit a complaint to the Seller in an attempt to reach an amicable solution.
If this process is unsuccessful, the consumer may use, free of charge, the consumer mediator appointed by the Seller, under the conditions provided for by the French Consumer Code.
These GTC are governed by French law.
In the event of any difficulty concerning the interpretation, performance or validity of these GTC, the parties are invited to seek an amicable solution as a priority.
Where the Customer acts as a consumer, the mandatory legal rules relating to the territorial jurisdiction of the courts remain applicable.
No provision of these GTC deprives the consumer of any mandatory protection to which they are entitled under applicable law.
